Terms & Conditions
These Terms and Conditions ("Terms") govern your access to and use of the AD22 website, your enquiries, bookings, purchases, and all other interactions with Animas Domus XXII ("AD22", "we", "us" or "our"). AD22 is a styling studio, event space and design atelier located within the Vampt Vintage Design building in Newtown, Sydney, Australia.
By accessing our website, making an enquiry, placing an order, subscribing to our mailing list, or attending any event or experience, you agree to be bound by these Terms. These Terms are governed by the laws of New South Wales and the Commonwealth of Australia, including the Australian Consumer Law ("ACL").
1. About AD22
AD22 — Animas Domus XXII — is a creative enterprise founded by David Beeman and Agnitha (Agi) Thomas, operating from 475 King Street, Newtown NSW 2042, Australia. We offer four principal services:
- Property Styling — full-service styling for residential sale campaigns and private homes.
- Space Hire — 170 sqm of designed event and production space for shoots, workshops, launches, exhibitions, and intimate events.
- Furniture & Objects — curated vintage, restored, and contemporary design pieces available for sale, hire, or installation.
- Evenings & Programming — cultural events, talks, and experiences hosted at or produced by AD22.
2. Acceptance of These Terms
By engaging with our services you confirm that you are at least 18 years of age (or have parental consent), have read and agree to these Terms, and have authority to enter into a binding agreement on your own or your organisation's behalf.
3. Enquiries, Bookings, and Agreements
3.1 Enquiries
Submitting an enquiry does not constitute a binding booking. All enquiries are subject to availability and will receive a response within five (5) business days.
3.2 Booking Confirmation
A booking is confirmed only when we have provided written confirmation, you have signed any applicable agreement, and any required deposit has been received and cleared. We reserve the right to decline any enquiry at our discretion.
3.3 Property Styling and Space Hire
Each engagement is governed by a separate service or venue hire agreement provided at the time of booking. That agreement supplements these Terms and prevails in the event of any conflict.
4. Pricing, Payment, and GST
All prices are in Australian Dollars (AUD) and inclusive of GST at 10% unless otherwise stated. Overdue invoices may attract interest at 10% per annum plus reasonable recovery costs.
5. Cancellations, Refunds, and Rescheduling
5.1 Cancellation by You
Written notice is required. The following terms apply unless otherwise agreed:
- More than 30 days before: deposit is non-refundable; no further amount payable.
- 15–30 days before: 50% of the total booking fee is payable.
- Fewer than 15 days before: 100% of the total booking fee is payable.
5.2 Cancellation by AD22
Where we cancel through no fault of yours (including force majeure), we will refund amounts paid in full or apply them as credit toward a future engagement.
5.3 Australian Consumer Law
Nothing in this clause limits any right you may have under the ACL, including the right to a refund for a major failure.
6. Furniture, Objects, and Products
- Vintage and restored items naturally carry marks and wear consistent with their history — this is not a defect.
- Title and risk pass to you upon payment in full and collection or delivery.
- We do not accept returns on change-of-mind purchases. ACL consumer guarantees apply.
7. Events and Experiences
- Tickets are non-refundable except where the event is cancelled by AD22 or required by the ACL.
- We reserve the right to alter programming and to refuse entry to or remove any person whose behaviour is disruptive or endangers others.
- Photography and video may be taken at AD22 events for marketing and archival purposes. Please advise staff if you do not wish to appear.
- Where alcohol is available, you must be 18 or older. Valid proof of age may be required.
8. Marketing Communications and Consent
8.1 Mailing List Subscription
When you subscribe to the AD22 mailing list — via our website, at an event, in person, or through any other channel — you expressly consent to receive electronic marketing communications from us, including newsletters, event invitations, new arrivals, promotions, and collaborations.
8.2 How We Communicate
We send marketing communications primarily by email, using Mailchimp (operated by Rocket Science Group LLC). By subscribing, your information is also subject to Mailchimp's Privacy Policy at mailchimp.com/legal/privacy.
8.3 Your Right to Withdraw Consent
You may unsubscribe at any time at no cost by clicking "Unsubscribe" in any email, or by contacting us at hello@ad22.au. We will honour requests within five (5) business days in compliance with the Spam Act 2003 (Cth). Unsubscribing does not affect transactional or service communications.
8.4 Compliance
All commercial electronic messages will clearly identify AD22 as the sender, include our contact details and address, and contain a functional unsubscribe mechanism. We will not sell or transfer your email address to third parties for their own marketing purposes without your express consent.
9. Privacy and Personal Information
9.1 Collection
We collect personal information (name, email, phone, address, payment details) when you enquire, book, purchase, subscribe, or attend an event — only what is reasonably necessary for our services.
9.2 Use and Disclosure
We use your information to provide services, process payments, send consented marketing, and meet legal obligations. We may disclose it to service providers (bound by confidentiality), regulators where required by law, and professional advisors. We will not sell your personal information.
9.3 Australian Privacy Principles
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You have the right to access, correct, and make a complaint about how we handle your information. Contact us at hello@ad22.au to exercise these rights.
9.4 Overseas Disclosure
Some service providers (including Mailchimp) are based in the United States. By using our services, you acknowledge your information may be stored or processed outside Australia under reasonable contractual protections.
10. Website Use
Our website is provided "as is." You must not use it unlawfully, introduce malicious code, attempt unauthorised access, or scrape content without consent. We are not responsible for the content of any linked third-party sites.
11. Intellectual Property
All content on the AD22 website and in our materials — text, photography, design, graphics, video, and brand elements — is owned by AD22 or its licensors. You may share content for personal, non-commercial purposes with attribution. Commercial use requires our written consent. Enquiries: hello@ad22.au.
12. Australian Consumer Law Guarantees
Nothing in these Terms excludes, restricts, or modifies any right or remedy under the ACL, including consumer guarantees for services and goods. To the extent permitted by law, our liability for a breach of any implied condition (other than an ACL consumer guarantee) is limited to re-supply of the service or replacement of the goods.
13. Limitation of Liability
To the maximum extent permitted by law, AD22's total liability shall not exceed the amount you paid for the relevant service or product. We are not liable for indirect, consequential, or punitive loss, or for damage to property brought onto our premises unless caused by our gross negligence.
14. Force Majeure
AD22 is not in breach and will not be liable for delay or failure caused by circumstances beyond our reasonable control, including acts of God, pandemic, natural disaster, or government action. We will notify you promptly and use reasonable endeavours to minimise impact.
15. Complaints and Dispute Resolution
Please contact us first. We acknowledge complaints within two (2) business days and aim to resolve within 15. Unresolved privacy complaints may be referred to the Office of the Australian Information Commissioner (oaic.gov.au); consumer complaints to NSW Fair Trading (fairtrading.nsw.gov.au).
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
17. Amendments
We may update these Terms from time to time. The current version will always be on our website. Active subscribers will be notified of material changes by email. Continued use of our services constitutes acceptance of any updated Terms.
18–19. General
If any provision is found invalid, the remainder continues in full force. A failure to exercise any right is not a waiver. These Terms, together with any applicable service agreement, constitute the entire agreement between you and AD22.
